1. Agreement to Terms

By accessing or using the MailMart platform at mailmart.com (the "Service"), you agree to be bound by these Terms of Service ("Terms"). If you do not agree, please do not use our Service.

2. Description of Service

MailMart provides Microsoft 365 inbox infrastructure management for cold email outreach. Our services include:

  • Domain infrastructure setup and DNS management
  • Microsoft 365 mailbox provisioning (49-99 inboxes per domain)
  • Cloudflare DNS integration and configuration
  • SPF, DKIM, and DMARC record management
  • Integration with email sending platforms (Instantly, SmartLead, etc.)
  • Unlimited domain swaps
  • Whiteglove setup and ongoing monitoring

3. Account Registration

To use our Service, you must create an account. You agree to provide accurate, current, and complete information during registration and to keep your account information up to date. You are responsible for safeguarding your account credentials and for all activity under your account.

4. Acceptable Use

You agree to use the Service only for lawful purposes. You shall not:

  • Use the Service to send spam, phishing, or malicious emails
  • Violate any applicable laws, regulations, or third-party rights
  • Attempt to gain unauthorized access to any part of the Service
  • Interfere with or disrupt the integrity or performance of the Service
  • Use the Service in a manner that could damage, disable, or impair our infrastructure
  • Resell, sublicense, or redistribute the Service without our consent

We reserve the right to suspend or terminate accounts that violate these terms, engage in abusive sending practices, or negatively impact the deliverability of other users.

5. Pricing and Payment

Service pricing is based on a per-domain, per-month model as displayed on our pricing page. Prices are subject to change with notice. All payments are due in advance and are non-refundable unless otherwise specified.

  • Starter (1–10 domains): $39/domain/month
  • Growth (10–100 domains): $29/domain/month
  • Enterprise (100+ domains): $25/domain/month

6. Domain Swap Policy

We offer unlimited domain swaps. If a domain stops performing to expectations, you may request a swap at no additional cost. Domain swaps are processed on a best-effort basis.

7. Service Level

We strive to maintain high deliverability and uptime. However, we do not guarantee specific deliverability rates, reply rates, or inbox placement scores, as these depend on many factors outside our control, including your sending practices, content, and target audience.

8. Intellectual Property

All content, features, and functionality of the Service — including but not limited to the website design, text, graphics, logos, software, and underlying technology — are owned by MailMart and are protected by intellectual property laws.

9. Limitation of Liability

To the fullest extent permitted by law, MailMart shall not be liable for any indirect, incidental, special, consequential, or punitive damages, including loss of profits, revenue, data, or business opportunities arising from your use of the Service.

Our total liability for any claim arising from or related to these Terms shall not exceed the amount you paid us in the twelve (12) months preceding the claim.

10. Indemnification

You agree to indemnify and hold harmless MailMart, its officers, employees, and agents from any claims, damages, or expenses arising from your use of the Service, your violation of these Terms, or your violation of any rights of a third party.

11. Termination

Either party may terminate the service at any time. Upon termination, your right to use the Service ceases immediately. We may retain certain data as required by law or for legitimate business purposes. No refunds are provided for partial months of service.

12. Changes to Terms

We reserve the right to modify these Terms at any time. Material changes will be communicated via email or through the Service. Your continued use of the Service after changes constitutes acceptance of the updated Terms.

13. Governing Law

These Terms shall be governed by and construed in accordance with applicable laws, without regard to conflict of law provisions.
